How to Win a Criminal Case: Tips That Can Save Your Butt

With an average of 521 criminal cases for every 100,000 people in the country, America is a country that takes criminal law very seriously. These cases can be difficult to navigate, especially if you are new to the justice system or feel you’ve been wrongfully accused. However, with the right information and assistance from an experienced defense attorney, there is a good chance you will come out on top.

The following tips can help reduce your conviction risk and even dismiss your charges.

Know the Basics of Criminal Law

Criminal law governs the prosecution and punishment of people who break the law. In other words, it involves the government prosecuting people for breaking the law. The most common types of criminal laws prohibit murder, theft, assault, and other violent crimes. The government has the power to arrest and prosecute people who break these laws. This power comes from the government’s authority over society.

It also has the power to punish people who break the law with things like prison time, fines, or probation. Criminal law differs from civil law in that it deals with society. Civil law deals with the rights and obligations of individuals. This includes issues like debt and contract disputes.

Be Aware of Your Rights During Interrogation

While interrogating, you have the right to remain silent and have an attorney present. This means you do not have to answer any questions from the police, even if you’re innocent. If you talk to the police without a lawyer, anything you say can be used against you in court.

This includes making an admission or even just giving a detail that could be used to support an accusation. But the right to remain silent is not absolute. If you are arrested on probable cause, you must talk to the police. Probable cause is a reasonable belief that a crime was committed and that you committed it.

Attend all of your court appearances

Being in court is one of the most important parts of a criminal case. Your attorney will be there to represent you, but you need to be there as well to make your case.

Failing to appear in court could negatively impact your case. You could even be deemed a fugitive and be placed under federal or international arrest.

Hire a Good Defense Attorney

When you hire an attorney, you hire someone to represent your interests in court. This person will advise you, question witnesses, and argue on your behalf. Your criminal defense attorney will also be in the best position to know how to get the charges against you dropped or reduced. It’s important to choose an attorney carefully. While you don’t necessarily have to hire the first attorney you speak to, it’s best to interview a few before making a decision.

Get one with experience in your particular area of law and who has a good reputation. When hiring an attorney, prepare to pay a retainer. You pay this set amount of money upfront to secure representation. Be advised that money should not be the only factor determining which attorney to hire.

If you’ve been arrested, it’s important to know that you are innocent until proven guilty. While the police and prosecutors are obligated to follow the law, you do not have to. You should know what to expect during your case is important. If you’re facing criminal charges, it’s a good idea to know the basics of criminal law and what you can do to defend yourself. It’s also a good idea to hire a good defense attorney to help you get the best outcome possible for your case.
