Once the court determines the amount of damages that will be awarded to the plaintiff, it will then review the complaint to determine if the plaintiff has a case.
The fourth and final requirement that plaintiffs must meet to have their lawsuit approved is that they must demonstrate that the amount of damages is necessary to cover the financial losses that resulted from the defendant’s negligence.
Again, it is not enough to simply show that the defendant caused the injury. The plaintiff must also prove that they suffered a financial loss as a result of the injury. If the plaintiff fails to establish these requirements of a case, their lawsuit will fail. If they are found in violation of these requirements of a case, they will lose their case.
