PETA Files First-Of-Its-Kind Lawsuit Against NIH, NIH, and HHS

PETA is a group that advocates for the rights of animals. The group is notorious for its wacky advertisements. For instance, PETA has suggested that we replace bacon with bagels to support the cause. They have condemned the former New Jersey Governor Chris Christie for swatting a spider. One of the group’s most famous campaigns was asking Ben & Jerry’s to make ice cream made from human breast milk, instead of cow’s milk. However, PETA was unable to get an advertisement running on Maryland’s buses. Fortunately, a federal judge has allowed them to continue their legal fight, despite the lack of merit.

The nonprofit organization, which spent tens of thousands of dollars on the case, has since dropped the lawsuit against the remaining defendants.

The case focuses on whether the government should prohibit ads by an organization. In PETA’s lawsuit, they argue that the ban violates the First Amendment’s Free Speech Clause. The government has previously banned advertising from public transportation systems in Washington, D.C., and Texas A& M. The university eventually agreed to reinstate the ads, stating that they violated PETA’s rights.

PETA’s lawsuit is the first of its kind and names the National Institutes of Health Director Francis Collins and Secretary of Health and Human Services Xavier Becerra. The group claims that the funding of sepsis research on animals has resulted in decades of failed studies and wasted taxpayer dollars. The lawsuit was filed under the federal Administrative Procedure Act.
